1. These regulations determine the limits of liability of the insurer of compulsory third-party liability insurance of owners of land vehicles (hereinafter – vehicles) (hereinafter – insurance) and the procedure for calculating insurance premiums.
II. Amounts of insurance premiums and the procedure for their calculation
2. The procedure for calculating insurance premiums is mandatory for all insurers that have received a license for the relevant type of insurance and carry out insurance operations.
3. If an insurance contract is concluded for a period shorter than a full calendar month (for example, for two and a half months), the insurance premium shall be determined in the amount provided for, including the relevant calendar month (except for insurance contracts concluded for one, two or fifteen days).
4. Insurance premiums for standard contracts, complex contracts, group contracts and border insurance contracts are determined in accordance with the Law on Compulsory Third Party Liability Insurance of Land Vehicle Owners and these regulations (Annex 1).

4.1. Insurance premiums for international compulsory civil liability insurance contracts (Green Cards) that are not valid in the territory of Latvia are determined in accordance with Table 4 of Annex 1 to these Regulations.

4.2. Insurance premiums for international civil liability insurance
for insurance contracts (Green Cards) valid in the territory of Latvia, calculated according to the formula:
ZKL = ZK + P(1 – X/100), where
ZKL – insurance premium for a Green Card valid in the territory of Latvia;
ZK – insurance premium for a Green Card not valid in the territory of Latvia (Table 4 of Annex 1);
P – the insurance premium of the corresponding standard contract (Annex 1), to which an increase or decrease has been applied in accordance with paragraphs 9, 10, 11, 12, 13, 14 and 15 of these regulations;
X – reduction of insurance premium in accordance with Table 4 of Annex 2 to these Regulations.

5. For trucks, buses and vehicles built on their basis registered in Latvia, with which licensed international commercial transport of goods and passengers is carried out and whose owner or authorized user can present an international compulsory civil liability insurance contract (Green Card), concluded for at least three months, the insurance premiums specified in Tables 1., 2.1.1., 2.1.2. and 3.1.1. of Annex 3.1.2 to these Regulations shall apply until the expiry of the Green Card.
6. Insurance premiums for vehicles registered abroad are determined in accordance with Table 1 of Annex 8.1 to these Regulations. If the owner or authorized user of a vehicle registered abroad can present a valid international compulsory civil liability insurance contract (Green Card) when concluding a border insurance contract, insurance premiums are determined in accordance with Table 1 of Annex 8.2 to these Regulations.
7. Taking into account the level of road traffic risk and the number of vehicles, the following additional coefficients for the vehicle premium are determined in the territory of Latvia (Appendix 1):
7.1. In Riga – coefficient 1,2 (surcharge code – “R”);
7.2. in the rest of the territory of Latvia – coefficient 1.
8. The insurance premium, when insuring no more than one vehicle, is reduced by 40 percent:
8.1. For disabled people of groups I and II (discount code – “I”);
8.2. Group III disabled persons who have a relevant driving license and who have body support disorders, as confirmed by a relevant opinion of the Medical Commission for Health and Work Capacity Expertise (discount code - "I").
9. The insurance premium shall be increased or decreased in accordance with the conditions referred to in paragraphs 8, 10, 11, 12, 13 and 15 of these Regulations, by applying the respective percentages to the amount of the vehicle insurance premium specified in Annex 1 to these Regulations.
10. If the insurance has been in force for the last 12 months prior to the conclusion of the insurance contract and during this period the owner or authorized user of the vehicle has not caused any road traffic accidents with the vehicle specified in the insurance policy, nor has the vehicle been driven under the influence of alcoholic beverages, narcotics, psychotoxic or other intoxicating substances, the amount of the insurance premium shall be reduced in each subsequent year (Table 2 of Annex 1).
11. If the insurance has been in force for the last 12 months prior to the conclusion of a new insurance contract and during this period the owner or authorized user of the vehicle has not caused any road traffic accidents with the vehicle specified in the insurance policy, nor has he driven this vehicle under the influence of alcoholic beverages, narcotics, psychotoxic or other intoxicating substances, and if he acquires the vehicle in accordance with a purchase, exchange or gift agreement or by inheriting it, the amount of the insurance premium shall be reduced when concluding an insurance contract in relation to the newly acquired vehicle (Table 2 of Annex 1).
12. If, in the last 12 months prior to the conclusion of a new insurance contract, the owner or authorized user of the vehicle has caused one or more road traffic accidents with the vehicle specified in the insurance policy or, during this period, has driven this vehicle under the influence of alcoholic beverages, narcotics, psychotoxic or other intoxicating substances, the amount of the insurance premium shall be increased (Tables 2 and 2 of Annex 3).
13. If, in the last 12 months prior to the conclusion of a new insurance contract, the owner or authorized user of the vehicle has caused one or more road traffic accidents with the vehicle specified in the insurance policy or has driven this vehicle under the influence of alcoholic beverages, narcotics, psychotoxic or other intoxicating substances during this period and if he acquires the vehicle in accordance with a purchase, exchange or gift agreement or by inheritance, the amount of the insurance premium shall be increased when concluding an insurance contract in relation to the newly acquired vehicle (Tables 2 and 2 of Annex 3).
14. If, in accordance with the conditions referred to in Paragraphs 12 or 13 of these Regulations, different percentage increases in the insurance premium may be applied to the owner or authorized user of the vehicle, the highest percentage increase shall be applied.

15. If in the previous calendar year the owner or authorized user of the vehicle has caused a road traffic accident while under the influence of alcoholic beverages, narcotics, psychotoxic or other intoxicating substances, the amount of the insurance premium is increased by 200 percent (surcharge code – “P8”).
16. If the insurer, when issuing an insurance policy, has incorrectly determined the amount of the insurance premium and it has been unreasonably increased, the insurer shall refund the overpaid part of the insurance premium to the policyholder. If the amount of the insurance premium has been unreasonably reduced, the policyholder shall pay the unpaid part of the insurance premium.
17. The amounts of insurance premiums applicable in the relevant year are calculated in accordance with the classification of vehicles (Annex 3).
III. Limits of liability of the insurer
18. The total limit of liability of the insurer in connection with the treatment and temporary disability of the victim is 10000 lats for each injured person.

19. The insurer's liability limit for a person killed in a road traffic accident is 400 lats for funeral expenses for each deceased person.
20. The limit of liability of the insurer in connection with permanent loss of working capacity caused to a person injured in a road traffic accident is 1000 lats per year for each injured person.

21. The insurer's liability limit for the dependents of a deceased person is 1000 lats per year for each person killed in a road traffic accident.

22. The insurer's liability limit for damage caused to a third party's property in a road traffic accident is 9000 lats.

22.1. If a road traffic accident has been caused by several persons and they have mutually suffered losses due to damage or loss of property, the insurance compensation that the civil liability insurer of each person who caused the road traffic accident pays to the victims in accordance with the degree of fault of the relevant person may not exceed the insurer's liability limit.

22.2. If the person who caused the road traffic accident has caused losses due to damage to or loss of property to several victims, the insurance indemnity paid to the victims may not exceed the insurer's liability limit.

22.3. If a road traffic accident causes damage to the property of several owners due to damage, destruction of vehicles or other property (except for the vehicle) and the total amount of damage exceeds the insurer's liability limit, the damage shall be compensated in the amount of the insurer's liability limit in proportion to the amount of damage to each victim.

22.4. If damage has been caused to the property of several owners in a road traffic accident and the total amount of damage exceeds the insurer's liability limit, the damage shall be compensated in the amount of the insurer's liability limit, taking into account the following distribution of compensation for damage:
22.4.1. for compensation for losses due to damage or destruction of a vehicle - 75 percent of the insurer's liability limit;
22.4.2. for compensation for losses due to damage or destruction of other property (except for a vehicle) - 25 percent of the insurer's liability limit.

22.5. If, in the case referred to in paragraph 22.4 of these Regulations , the amount of loss is less than that specified in the distribution of compensation for losses, this loss shall be compensated in full, but the remaining amount shall be paid out in proportion to the amount of losses of each victim.

23. When compensating for damage caused to the environment, the insurance indemnity may not exceed the insurer's liability limit – 1000 lats.

24. Clause 15 of these Regulations shall enter into force on 1998 January 1. Clauses 10, 11, 12 and 13 of these Regulations shall enter into force on 1998 September 1.
25. Clauses 5 and 6 of these Regulations shall be in force until the date on which the Republic of Latvia joins the international compulsory civil liability insurance (Green Card) system.
25.1. Clauses 7, 8, 9, 10, 11, 12, 13, 14, 15 and 17 of these Regulations shall not apply to international compulsory civil liability insurance contracts (Green Cards) that are not valid in the territory of Latvia.

25.2. If the amount of the insurer's liability limit is amended, the amendments shall apply to those insured events that have occurred after the relevant amendments have entered into force.

26. To declare the following Cabinet regulations invalid:

Vehicle classification
1. Passenger cars, vehicles built on their basis and minibuses, in which the number of seats (excluding the driver's seat) does not exceed eight seats, shall be divided into the following groups:
1.1. vehicles with a gross vehicle weight of up to 1200 kg;
1.2. vehicles with a gross vehicle weight of between 1201 and 1500 kg;
1.3. vehicles with a gross vehicle weight of between 1501 and 1800 kg;
1.4. vehicles with a gross vehicle weight of between 1801 and 2100 kg;
1.5. vehicles with a gross vehicle weight of between 2101 and 2600 kg;
1.6. vehicles with a gross vehicle weight exceeding 2600 kg.
2. Trucks and vehicles built on their basis shall be divided into the following groups:
2.1. vehicles with a gross vehicle weight of up to 3500 kg;
2.2. vehicles with a gross vehicle weight of between 3501 and 12000 kg;
2.3. vehicles with a gross vehicle weight of between 12001 and 20000 kg;
2.4. vehicles with a gross vehicle weight of between 20001 and 26000 kg;
2.5. vehicles with a gross vehicle weight of between 26001 and 30000 kg;
2.6. vehicles with a gross vehicle weight exceeding 30000 kg.
3. Buses and vehicles built on their basis shall be divided into the following groups:
3.1. vehicles with a gross vehicle weight of up to 3500 kg;
3.2. vehicles with a gross vehicle weight of between 3501 and 12000 kg;
3.3. vehicles with a gross vehicle weight of between 12001 and 20000 kg;
3.4. vehicles with a gross vehicle weight exceeding 20000 kg.
4. Motorcycles, scooters and vehicles built on their basis shall be divided into the following groups:
4.1. with an engine displacement of less than 250 cm3;
4.2. with an engine displacement of 250 cm3 and more.
5. Tractors and self-propelled vehicles are divided into the following groups:
5.1. wheeled tractors with an engine power of 50 HP (36,8 kW) and less; other tractor equipment (tracked tractors, bulldozers, excavators, road construction and maintenance machines, forestry machines, harvesters, self-propelled mowers, pipelayers, lifts, etc.);
5.2. wheeled tractors with an engine power exceeding 50 hp (36,8 kW).
6. Trailers shall be divided into the following groups:
6.1. trailers for passenger cars and vehicles built on their basis;
6.2. tractors and self-propelled trailers;
6.3. trailers for trucks with a gross vehicle weight of less than 10000 kg;
6.4. trailers for trucks with a gross vehicle weight of 10000 kg and more;
6.5. tankers and timber carriers.
