
How to claim compensation?
Insurance compensation for losses caused by a road traffic accident (RTA) is paid to victims of a RTA by the insurance company that insured the civil liability of the owner of the vehicle that caused the losses. If the vehicle of the person causing the RTA is registered and insured in another country, then the losses are compensated by the representative of this insurer in Latvia or, if there is none, – LTAB.
A person claiming insurance compensation shall notify the RTA and submit an application for an insured event to the insurer that insured the civil liability of the owner of the vehicle that caused the damage. The liable insurer can be found out here.
If the accident was caused by an uninsured vehicle, the losses are covered by the Guarantee Fund, which is administered by LTABIn cases where the insurance indemnity is to be paid from the Guarantee Fund, the application for the insured event shall be submitted to one of the insurers of one's choice, which is LTAB cooperation participant (“Baltic Insurance House”, ADB “Gjensidige” Latvian branch, “If P&C Insurance” AS Latvian branch).
If the damage was caused by a vehicle with a foreign registration plate, the application for the insured event shall be submitted to the insurer who is the third party liability insurance policy holder of the owner of the vehicle that caused the damage. insurer's representative in Latvia, or, if there is no representative, at the option of one of the insurers that is a member of the Motor Insurers' Bureau.
A person who does not claim insurance compensation shall submit to the insurerwith whom a compulsory civil liability insurance contract has been concluded, or, if there is none, a completed coordinated notification to the Motor Insurers' Bureau within 10 days of the RTA in the case when the circumstances of the RTA have been recorded using the coordinated notification forms, or inform in writing about the RTA if the circumstances of the road traffic accident have been recorded by the State Police.
If the persons involved in the traffic accident are known, but due to their contradictory testimonies it is not possible to determine the degree of responsibility of these persons, then when compensating for damages, it is assumed that the degree of responsibility of the persons involved in the traffic accident is the same. If the pedestrian who was injured in the traffic accident is not recognized as the cause of the traffic accident, and the fault of the driver of the vehicle involved in the traffic accident cannot be proven, the insurance compensation is paid LTAB.
